What is Compensation and how it is calculated

Compensation is given considering  number of factors

i) Actual loss –Injury or loss visible at first sight is generally considered actual loss. For Example;

  • Medical negligence leading to damage to the patient in any manner
  • Negligence by health care/Beauty care clinics causing skin problem after application of some chemicals or burn caused during treatment for weight loss et.The expenses born for treatment are actual losses.
  • Saree burnt at Drycleaners shop, cost of the saree. In case new saree meant for wedding occasion causes more mental agony than usual days

ii)Future Loss –Permanent disability due to negligence of service provider, causing employment loss or wage loss are future losses

iii) Incidental loss Incidental loss is a loss which occurs due to cases of deficiency in services or for supplying defective goods causing business loss.

iV) Compensation for Mental agony Pain and agony faced for such injury is compensation for mental agony.

V) Litigation Charges

In case sufferer has to go for litigation to get justice ,that further adds  as  litigation charges, may it be fee given to advocate or other expenses borne  for taking up case to  the court
