Two important factors

  1. Existence of Sec 13 & 15 of Railway Claims Tribunal1987 do not take away the jurisdiction of Consumer courts to decide the question of deficiency in services
  2. Consumer courts cannot sub -plant the jurisdiction of Railway Tribunals or any functions as quasi-judicial body.

Railway’s purpose

Transportation of luggage booked by industries and house hold goods of common citizens by charging freight, claims for damaged or lost goods
